By proceeding with this reservation through HVN Travel Group Inc. or our affiliates, you signify your consent to all terms; are acknowledging that you are authorized to represent, sign on behalf of, and make payments for the traveling party; and have authorized HVN to act as the representative and agent for you and the traveling party in executing on your behalf a rental agreement with the applicable property manager/owner that will require you and the traveling party to comply with the terms, conditions and rules that the property manager/owner requires in connection with your anticipated use of the property. Upon execution of such agreement on your behalf by HVN, HVN will forward to you reasonably in advance of the arrival date in your reservation for your review, a copy of the agreement setting forth the terms, conditions and rules applicable to your use of the property. In the event you object to the terms, conditions and/or rules set forth in such agreement, you may cancel your reservation as long as you notify HVN of such cancellation within 24 hours after receiving the contract and as long as the reservation is not under a non-cancellation policy, in which event HVN will use reasonable efforts on a timely basis to book another reservation for you at a property with terms, conditions, and rules of use that are acceptable to you. You agree to all terms and conditions on behalf of the traveling party, which include the HVN cancellation policy and all HVN booking terms, site terms and conditions, and privacy policy. Cancellation Policy. Cancel risk-free within 24 hours of booking if you book more than 30 days before check-in. After that, the reservation becomes non-refundable, and you will be responsible for paying the full value of the reservation. If your plans change due to exceptional circumstances, we will make best efforts to work with the property manager to determine what options, if any, are available on your behalf. However, refunds cannot be guaranteed. Please note that bookings that overlap Christmas and/or New Year’s are fully non-refundable upon submission. Travel Protection Insurance (Optional). We recommend considering optional travel insurance to protect against unforeseen events, such as trip cancellations, medical emergencies, or lost luggage. Travel insurance provides a safety net, helping you enjoy your stay without worry. For your convenience, HVN has partnered with a trusted, licensed travel insurance provider. Please read the policy details carefully to understand what is covered and what is not. Payment & Fees. You and the traveling party agree to pay the full cost of the reservation. If you do not pay, and it is collected through the use of a collection agency, an attorney, or through other legal proceedings, you and the traveling party agree to pay all costs or fees, including attorney fees and court costs, incurred in connection with such collection effort. Additional fees, deposits, and/or payments for incidentals or add-on services (including but not limited to refundable deposits, extra accommodations charges or fees, service fees, handling fees, destinations surcharges, duties and taxes, incidentals, telephone calls, insurance, laundry service, minibar, parking, and/or any other elected or incurred charges) may be charged by HVN or the property at or before the time of service, check-in, or check-out. Should additional fees be incurred during your stay related to property damage or services provided, you authorize HVN to charge the credit card on file for this reservation. Security Deposit. This reservation may require a refundable security deposit, as a separate consideration to the non-refundable damage waiver fee, to be collected prior to arrival. Guest will be responsible for any damages, loss of inventory, excessive cleaning fees, incurred violation fines or violation of occupancy specified during the rental period plus service charges, to be deducted from this deposit. Guest agrees to pay any additional costs in full should damages or fines exceed the amount of the security deposit. The security deposit will be refunded following check-out, less any applicable charges, typically within 30 days from the check-out date or otherwise as determined according to the property manager’s unit-specific terms. Peace of Mind Guarantee. In the event that your reservation is canceled or made unavailable by the homeowner or property manager more than five business days after your reservation is placed, HVN shall make best efforts to provide alternative accommodation of a similar or better value up to 10% more in total price than the original property booked. If we make every reasonable effort to locate alternative accommodations but are unable to secure accommodations on an arrival date that is suitable to you, per our Peace of Mind Guarantee, HVN will issue a refund or credit for 100% of the total booking value, excluding any additional fees incurred for previous reservation modifications, at which point HVN’s obligation for the reservation shall terminate without further liability to HVN and you agree to hold harmless our officers, agents, directors, employees, and sub-contractors. Exceptional Circumstances. Reservation modification requests related to Acts of God, including COVID-19 or any government restrictions, must be placed via our reservation modification request form and will be addressed on a case by case basis. Please be prepared to provide supporting documentation for your request. HVN will open an exceptional circumstances case with the property manager and make best efforts to determine what options, if any, are available on your behalf. Please note that all determinations by HVN with respect to exceptional circumstance related refunds, date changes, stay credits, alternative lodging placements, and other resolutions shall be at our discretion, final and binding. No-Shows, Unused Nights & Breach of Terms. Please note that if the traveling party is required to vacate the premises during the stay due to any violation of the house rules or rental agreement terms and conditions, with or without warning, you will not receive a refund for the time remaining in the reservation, nor will HVN be responsible for locating alternative accommodations. No refunds will be given for no shows, unused nights, or early check-outs. Guest Verification & Required Documentation. As required by the property manager/owner for security considerations and guest verification purposes, you agree to provide at least two forms of identification in the form of a valid driver’s license or passport and a major credit card. Should the property manager, homeowner, HOA, or resort community require additional forms of identification from you and/or other guests staying on premises, you agree to comply with these requests. Travelers are responsible for securing and bringing required travel documentation such as visas, valid vaccination cards, and PCR test results, and ensuring that they and their guests respect and are in full compliance with community, destination, and government-mandated COVID-19 requirements. HVN is not responsible for travelers complying with COVID-19 testing, masking, quarantine, vaccination, stay-at-home orders, tenant/house rules, or any other government-mandated requirements related to this reservation. All travelers, including children, must have current and valid personal and family documentation, such as passports, visas or national identifying documents, as required for the applicable destination. Special Requests. Travelers must make any special requests and disclosures at the time the reservation is placed regarding handicap and accessibility requirements, service animals, pets, allergies, dietary considerations, celebrations/events, and child needs such as a crib or childcare. Availability of specially requested items are subject to availability and at the discretion of the accommodating property. Concierge Services. By using Concierge Services, Guest acknowledges that third-party providers are independent entities and not affiliated with HVN. HVN makes no guarantees regarding the quality, legality, accuracy, or safety of these services and assumes no liability for any related issues. By booking Concierge Services, Guest agrees to release, indemnify, and hold harmless HVN from any claims, damages, or losses arising from third-party services, including accidents, injuries, or property damage. Additional terms and conditions may apply to Concierge Services. Packages & Mail. HVN is not responsible for mail or packages that are shipped to the property. We do not have access to the mailboxes at this rental property and cannot retrieve mail for our guests. If you choose to ship an item or mail to the property, HVN is unable to receive or sign for the items on your behalf. We are not liable for items shipped to the property that are lost, stolen, or otherwise not received. Travelers are solely responsible for their belongings at all times during the stay. All luggage and personal belongings are carried at travelers’ own risk. Travelers must make any claims for the loss or damage of personal belongings directly with the applicable shipping service company or local authorities. Limitation of Liability. HVN operates a professional B2B listing site and as such cannot fully guarantee the accuracy of the information (including, but not limited to, descriptions, pictures, and amenities) of any properties or services displayed on HVN operated websites provided by the property manager/owner, and disclaims all liability for any related errors or inaccuracies. HVN is not responsible for any acts and/or omissions of accommodation suppliers, their employees, agents, or representatives. In the event an offer is listed at an incorrect price or with incorrect information, including property location, we reserve the right to update the listing at any time, before or after a reservation is booked, without liability, including direct or indirect losses to the traveling party as a result. In such an event, we will offer the opportunity to keep the reservation at the corrected pricing or cancel the reservation without penalties or fees. While we work hard to ensure travelers have great experiences with properties booked through the HVN platform, we do not and cannot control the conduct of property managers/owners and travelers and their guests. HVN Travel Group Inc. and all its subsidiaries, officers, agents, directors, employees, sub-contractors, and suppliers of services pursuant to, or in connection with, this reservation do not assume any liability whatsoever for any injury, damage, death, loss, accident person or property due to an act of negligence or fault of others, including any accommodation, company or person rendering any of the services included, or by acts of God. Further, no responsibilities are accepted for any damage or delay due to sickness, pilferage, labor disputes, machinery breakdown, quarantine, government restraints, weather or other causes beyond our control. Chargeback Policy. We take a zero-tolerance approach to chargeback fraud. By placing a booking through HVN’s online payment platform, you acknowledge that you have the authority to use the credit card(s) used to place the reservation. Chargebacks occur when your credit card provider requests that we return monies on a transaction which you dispute or claim is fraudulent. We recognize that chargebacks can happen for a variety of reasons. However, if you make a credit card payment through us in respect of a booking, and you or any member of the traveling party later disputes this legitimate charge by raising a chargeback without merit (in our sole discretion), whether fraudulently or otherwise, we may take steps to recover any expenses resulting from such an unmerited chargeback from you or the traveling party directly. Furthermore, in the event of any unmerited chargeback requests, we reserve the right to recover any monies by all legal means available to us, including using a third-party debt collection agency, or any other lawful means to recover funds successfully charged back to you in such circumstances.
